Greater St. Louis Metropolitan Area - Hof Law, LLC has formally submitted the firm's sixteenth proposal to the Bipartisan House Department of Government Efficiency (DOGE) Caucus, urging the formalization of written Delegations of Authority for Special Government Employee Elon Musk. The proposal aims to enhance clarity in dilineated roles in Mr. Musk’s role within The Executive.
Recent press reports indicate that a March 6, 2025, meeting could have resulted in a significant verbal change to Mr. Musk’s delegated authorities. If so, clear and simple delegations of authority documents could provide new clarity relating to the extent of Mr. Musk's delegated authorities when operating within the Executive. The firm’s proposal emphasizes the importance of such formality to prevent confusion over decision-making responsibilities, prevent future in-fighting, and support ethics counselors providing guidance relating to Post Government Employment (PGE) regulations, 5 C.F.R. 5 C.F.R. § 2641.101, et seq, that will presumably govern Mr. Musk's behavior when he unencumbers his role.
“With Mr. Musk playing a key advisory role in the Department of Government Efficiency, it is vital that his authority and responsibilities are clearly defined in writing,” said Joe Hof, Managing Attorney at Hof Law, LLC. “Establishing formal Delegations of Authority will strengthen accountability, reduce bureaucratic inefficiencies, and support government ethics compliance.”
Additionally, the proposal highlighted the existence of a potential divergence between the Bipartisan House DOGE Caucus and The Executive's DOGE, as suggested by recent updates to Congressman Aaron Bean’s website that occurred earlier this month or in late February 2025. What may seem as a immaterial website update could be material to future ethics analysis of folks representing back to the Government after leaving Federal service, which is the very thing that both DOGEs are asking folks to do.
